Essentiality in FRAND licensing

Essentiality analysis asks whether a standard can be implemented without infringing a patent claim. Claim charts make that question concrete: each claim limitation is tested against the relevant specification, version and conditions. This gives licensing teams a technical basis for assessing which patents support a portfolio’s asserted scope.

Under ETSI’s IPR policy, FRAND commitments concern essential rights. Assessing essentiality grounds discussions about portfolio scope and royalties in technical evidence. ETSI declarations identify patents reported as essential or potentially essential; ETSI does not verify that those patents are essential.
